Booking Terms
All bookings are made and accepted subject to the terms set out in these booking conditions. These booking conditions ensure that you get a fair deal. Please read the following booking conditions carefully.
Your Booking
When you instruct us to confirm your booking, a minimum deposit of 20% when booking flights or 10% if not booking flights through ourselves is payable immediately. Our contract with you under the terms of this charger takes effect when we confirm your booking to you via e-mail. We will then send you a statement of costs confirming your booking, showing details and price of your travel arrangements and once payment of this deposit is received we will send you out a letter of receipt. Please take the time to check the statement of costs upon receipt, to ensure that it reflects what you intended to book.
Price
Prices quoted are inclusive of all UK and foreign airport taxes. Prices are based on exchange rates published by FTO. Prices are subject to surcharges on the following items: government action, currency, aircraft fuel, over flying charges, airport charges, increase in schedule airfares and other aviation costs made by the appropriate authority. In any event we will absorb an amount equivalent to 2% of the price quoted to you, excluding insurance premiums and any amendment charges. Only amounts in excess of 2% will be surcharged, but where a surcharge is payable there will also be an administrative fee of £ 1. If the surcharge amounts to more than 10% of your confirmation invoice, you will be entitled to cancel your booking with a full refund of all money paid except for any holiday insurance premiums and amendment charges. Should you decide to exercise your right to cancel, you must do so within 14 days from the issue date printed on the adjusted invoice. Clients will be notified of any surcharges before the final balance is due.
Payment
You must pay a deposit of 20% when holiday includes flights or 10% if not booking flights through ourselves immediately upon receipt of your statement of costs. You must pay the balance due on receipt of the final invoice and no later than 8 weeks prior to the departure date. If a booking is made within 8 weeks of the departure date, the full cost is payable immediately. It is important that you make your payments in time, otherwise your booking may be cancelled, and you may be liable for cancellation charges as set out below.
If you change your booking
Should you wish to change your booking arrangements, a minimum administration fee of £25 is charged for each amendment, or each name change (this may differ considerably dependent on which airline booked). Changes made within 8 weeks of departure may be amended (depending again on which airline booked) but otherwise will be considered as a cancellation, and cancellation charges will apply. All changes must be confirmed by email.
If you cancel your booking
If you cancel your booking before 56 days prior to departure, you will lose your deposit. If you cancel your booking within 55-29 days prior to departure, cancellation charges equivalent to 80% of the cost of your holiday will apply. If you cancel your booking 28-0 days prior to departure, cancellation charges equivalent to 100% of the cost of your holiday will apply. If you advise us of a cancellation, after the booked date of departure no refund will be made. Cancellations must be confirmed in writing, and sent by recorded delivery. If you curtail your holiday for whatever reason, without prior agreement with us, we will not consider any request for compensation, refunds or additional expenses incurred by you whatsoever. If you are prevented from traveling on an aircraft, because in the opinion of someone in authority, your behavior is likely to cause discomfort or disturbance to others, or because you appear to be unfit to travel due to misuse of drugs, or other intoxicating substances, our responsibility for your holidays thereby ends. Full cancellation charges will be levied and no refunds will be given. We shall be under no obligation whatsoever, for any costs you incur in making alternative arrangements.
If you have a complaint
Should you have a problem with any aspect of your travel arrangements as booked with Family Diving Limited, you must notify us or our local representatives at your holiday destination immediately, so that we are given the opportunity to solve the problem as soon as you report it, while you are still on holiday. It is not acceptable to us, to be kept unaware of a complaint, and for you to delay making known your complaint to us, until after you return home from your holiday. If we or our representatives cannot resolve your complaint at your holiday destination, and you wish to take up the matter on your return, you must write to ourselves within 28 days of your return.
Conditions of Carriage
All transportation by air is subject to the terms and conditions of the company providing the transport, some of which limit or exclude liability. These conditions are often the subject of international agreements between countries and copies of the conditions are available for inspection at the offices of the carrier concerned. We accept no liability in all of these cases.
If we change your booking
If, in the unlikely event we may have to change your holiday booking (most changes are usually of a minor nature) but in accordance with the Fair Trading Charter, if a significant alteration is made to a booking which has already been confirmed, we guarantee to inform you as soon as is reasonably practical if there is time before your departure. Occasionally the change may be major and this would involve altering:
Your UK airport
Your scheduled time of departure or return by more than 12 hours.
Your accommodation (if booked through us) to a lower star grading.
In the unlikely event, that we do advise you of such a change, you can either:
a) Accept the new arrangements as offered.
b) Make a new booking at cost.
c) Cancel your booking and receive a full refund of monies paid.
If you choose options a) or b) we shall compensate you on the scale shown below by issuing a credit against the cost price of the new arrangements. If you choose option c) we shall issue a full refund together with a compensatory payment on the scale shown below:
Over 56 days before departure - Nil
29 – 56 days before departure - £10
15 – 28 days before departure - £15
0 – 14 days before departure - £20
Compensations are per person, excluding infants. We shall endeavor to avoid making such changes especially within two weeks of your departure. In the unlikely event that an airline should withdraw a flight or transfer passengers to an alternative service, we will arrange the most suitable reservations and advise you as quickly as possible. If this means you have to travel on a different day to that originally booked, you may cancel your booking under the provisions described above. However, a flight delay resulting in a change of departure date does not affect the price.
Under no circumstances will compensatory payments be made when alterations or cancellations by us result from circumstances amounting to ‘force majeure’ or other situations beyond our control such as : flight delays, war, threat of war, riot or civil strife, terrorist activity, natural disaster, fire, sickness, weather conditions, actions of any airport, government or public authority, technical problems to transport, airport regulations, temporary technical, electrical or mechanical breakdown of any aspect of your booked arrangements, hotel over bookings, (if booked through us) not caused by us, or circumstances amounting to Act of God.
If we cancel your holiday
We reserve the right in any circumstance, to cancel your booking but in no case (except for reasons of ‘force majeure’ described above) will we do so within 8 weeks of your departure date. If we cancel your booking, a full refund of all monies paid will be issued, or alternatively you may accept some other arrangement we may offer or you may choose to make a new booking from us, Whatever your choice is, we shall compensate you on the scale outlined above unless the cancellation is caused by circumstances which amount to ‘force majeure’.
Your Financial Protection
When you buy an ATOL protected air holiday package from us, Family Diving Limited, you will receive a Confirmation Invoice from us confirming your arrangements and your protection under our Air Travel Organiser's Licence number 9028.
In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. For further information visit the ATOL website at www.atol.org.uk.
